Terms & Conditions

1. There are no long-term contracts. You can cancel at any time you want to.
2. You get the first 30 days for free (unless you are getting a custom-designed package).
3. When the 30 days is up, and you continue to use our service, we will start the automatic monthly billing cycle.
4. Cancellations are processed on a monthly block basis. We do not have the resources for pro-rating packages. The day you sign-up will be your billing cycle date. Cancellations are processed on the next billing cycle, with a minimum 10 day notice.
5. You can have as many listings and photos as you like.
6. Although we will try not to, we may have to raise the monthly subscription cost in the future. In this case we will give you at least 2 months notice. This is not likely to happen often, however.
7. When you sign up, we provide you with an email system hosted by Google Apps, a premier email and collaboration system for businesses. Google Apps allows you to use your native domain (@yourname.com) on their servers, and offers seamless integration with your computers, iphones, blackberries and more.
8. We are here to stay, and for long we will stay. That means we will continuously be improving our systems, adding new themes available, and your feedback is always welcome. Of course we cannot make every feedback happen, but if there's enough call for certain features or functions, chances are we will add that on.

Your Obligations

1. Please try to make your payments on time.
2. We understand that sometimes you can be late on payments. When a payment bounces we will give you 15 days to make a manual payment and update our credit card records. After the 15 days, however, your account will be suspended. 30 days after the initial payment was failed, your account will be removed from our system.
3. The content is your responsibility to upload.
4. Please do not post pictures/videos/content that you do not have authorization to use. Such action can result in immediate account termination with no refunds.
5. You may not list properties you are not authorized to list. They must be either your own listings, or a co-listing that you are part of, or with permission from the actual listing agent. Violation of this term may result in immediate account termination with no refunds.
6. You must be a registered real estate agent. This is service may not be used to aggregate listings from other sites. Violation of this term may result in immediate account termination with no refunds.

The Service

1. The monthly subscription cost covers the cost of server maintenance, software usage license, and email routing.
2. It also includes technical support for using the Brixwork for Realtors system, as well as periodic upgrades on the software to make things easier and faster.
3. It does not include any functionality changes or design changes to the site. Such requests need to be consulted with us, and we will provide such services on a custom-payment basis.
4. For customized design work or functionality changes, our hourly rate is $75/hr. This rate is subject to change in the future.
5. We prefer digital support over phone support. The reason is that phone support does not leave any records automatically, and is a difficult medium to use when attempting to troubleshoot website issues. Our support system allows tracking of trouble tickets and their statuses, and it allows file attachments as well. At this point we do not have phone support for technical issues.

License Terms for Brixwork for Realtors Software

1. The Brixwork management software always remains the property of Sonika Studios Inc.
2. Your monthly dues cover your access to the software for the duration of the payment, not ownership of the software.
3. Our software is not transferrable. This means there is also no FTP access to our servers whatsoever.
4. The optional Wordpress software, however, is an open source project by www.wordpress.org. We do not own this software, but we use it under the open source license.
5. The wordpress themes we attach to your stock theme, however, remains the property of Sonika Studios Inc.

License Terms for Custom Design Clients

1. This set of terms apply only to clients who are having a custom theme designed.
2. Brixwork for Realtors is not offered for ownership. You have the license to use the software on a lease for the duration in which you make your monthly payments.
3. When you get a custom design from us, however, the design itself is your intellectual property. The software is not.
4. If, per chance, you wish to take your design to another web developer, the only portion we can provide is the actual design elements, not the database elements. This means that you will have an empty shell with the graphics, rather than the whole site, if you choose to take the design on your own.
5. If we design a custom wordpress theme for you along with your realtor site, that also is your property that you can take wherever you wish.
6. We do not provide any kind of technical support for integrating our designs with 3rd party software.
7. Of course, we're very confident you will stay with us, so hopefully this will never arise as an issue!
